Welcome to Autophoto, an AI-powered, cloud-based photo editing and retouching service.
Autophoto is operated by Autophoto Labs Private Limited (“Autophoto”, “we”, “our”, or “us”).
These Terms and Conditions (“Terms”) govern your access to and use of our services, website, APIs, and digital platforms (collectively, the “Services”). By using the Services, you agree to these Terms. If you do not agree, you must discontinue use immediately.
1. Acceptance of Terms
By accessing or using Autophoto, you confirm that you have read, understood, and agree to these Terms, our Privacy Policy, and our Refund Policy, which together form a binding agreement.
If you are using the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
2. Eligibility
The Services are intended strictly for professional and business use.
You must be at least 18 years old and legally capable of entering into a binding contract to use the Services. Use by minors is not permitted.
3. Description of Services
Autophoto provides AI-powered, cloud-based photo editing, retouching, and automation services.
Outputs are generated automatically and may contain errors or inaccuracies. We do not guarantee output accuracy, completeness, or suitability for any specific commercial purpose. Human review is recommended before use.
We reserve the right to modify, suspend, or discontinue any part of the Services with or without notice, where permitted by law.
4. Account Registration and User Responsibilities
To access certain features, you must create an account using accurate and complete information.
You are responsible for:
- Maintaining the confidentiality and security of your account
- All activity conducted under your account
- Ensuring you have all necessary rights and permissions to upload content
- Using the Services in compliance with applicable laws
- Not uploading unlawful, infringing, deceptive, or harmful content
- Not attempting to disrupt, reverse engineer, or bypass platform safeguards
You must notify us immediately of any unauthorized account access.
5. User Content and Intellectual Property
5.1 User Content
You retain ownership of all content you upload.
By using the Services, you grant Autophoto a worldwide, non-exclusive, royalty-free license to host, store, process, analyze, modify, and transform your content solely for the purposes of:
- Providing and operating the Services
- Improving system performance, reliability, and accuracy
- General AI model training and improvement, as described in the Privacy Policy
- Complying with legal obligations
This license does not transfer ownership of your content to Autophoto.
5.2 Autophoto Intellectual Property
All trademarks, logos, software, workflows, AI models, algorithms, platform designs, and related intellectual property are the exclusive property of Autophoto Labs Private Limited.
You may not copy, modify, distribute, sell, or exploit any part of the Services except as expressly permitted.
6. Payments, Subscriptions, and Billing
Autophoto offers free and paid plans.
Paid plans are billed monthly or annually in advance via secure third-party payment processors.
By purchasing a paid plan, you agree to:
- Pay all applicable fees on time
- Accept automatic recurring billing where applicable
- Maintain accurate billing information
- Be bound by the Refund Policy
Except as expressly stated in the Refund Policy, all fees are non-refundable.
7. Service Availability and Modifications
The Services are provided on a commercially reasonable basis.
We do not guarantee uninterrupted, secure, or error-free operation. Features, limits, and pricing may change. Continued use constitutes acceptance of such changes.
8. Third-Party Services
The Services integrate with third-party services, including payment processors and cloud infrastructure providers.
We are not responsible for third-party services, outages, content, or policies. Your use of third-party services is governed by their respective terms.
9. Privacy and Data Protection
Your use of the Services is subject to our Privacy Policy, which explains how personal data and uploaded content are processed.
By using the Services, you consent to such processing as described in the Privacy Policy.
10. Acceptable Use
You agree not to use the Services to:
- Upload illegal, infringing, deceptive, or harmful content
- Violate intellectual property or privacy rights
- Train or develop competing AI systems using the Services
- Abuse refunds, pricing, or platform limits
- Attempt unauthorized access or security breaches
- Circumvent technical restrictions
We may suspend or terminate access immediately for violations.
11. Limitation of Liability
To the maximum extent permitted by law:
- The Services are provided “as is” and “as available”
- All warranties, express or implied, are disclaimed
- We are not responsible for AI output accuracy or business decisions made using outputs
Our total aggregate liability shall not exceed the amount paid by you to Autophoto in the one (1) month immediately preceding the event giving rise to the claim.
This limitation applies to all claims, whether in contract, tort, or otherwise, including but not limited to data loss, service interruptions, output errors, and third-party claims.
12. Force Majeure
We are not liable for any failure or delay caused by events beyond our reasonable control, including natural disasters, internet outages, cloud provider failures, government actions, or legal restrictions.
13. Termination and Suspension
User Termination
You may cancel your account at any time. Access continues until the end of the billing period, where applicable.
Company Termination
We may suspend or terminate access for:
- Violations of these Terms
- Fraud, abuse, or security threats
- Non-payment
- Legal or regulatory requirements
Service Discontinuation
If Autophoto permanently ceases operations:
- Reasonable notice will be provided where possible
- Users will have time to export data
- Refunds will be handled strictly in accordance with the Refund Policy
- Data deletion will follow the Privacy Policy
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India.
The courts located in Udaipur, Rajasthan, India shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the use of the Services.
15. Changes to Terms
We may update these Terms from time to time. Continued use of the Services after updates constitutes acceptance of the revised Terms.
